This is about you as a (future) customer of our company, or as a supplier, or a person concerned in another organisation with whom we are in contact.

2. Your right to privacy

You have a number of rights that govern the processing of your personal data.

Your data protection rights will be implemented in our systems and procedures within 30 days from the date of receipt of your application. If, for any reason, we are unable to meet this deadline, we shall inform you prior to the date of expiry of the original deadline.

Your right to view your personal data

You have the right to be informed of your personal data which we are processing, the purpose for processing them, where we have obtained these data, and the recipients of these data.

If you so decide, you can also be informed about how long we are storing these data, whether these data are used for automated decision-making purposes, and whether we intend to send these data to a country outside of the European Union.

You will receive the information requested by post or by e-mail within a reasonable period of time.

Your right to rectification/completion

There is always a possibility that the data which we hold about you is not, or no longer, accurate. In that case, you may always request to have the incorrect data amended or any missing data completed.

Your right to erasure

If you consider that we are unlawfully processing your personal data, then you may request to have these personal data deleted. Avasco Solar may refuse an application to have data deleted if there are grounds to do so. For example, to institute legal proceedings or to support a legal claim or to comply with a legal obligation to store certain data.

Your right to restriction of processing

You may request that we restrict the processing of your personal data if you suspect that the data are inaccurate, if the processing is unlawful, or if you do not agree that we are processing the data on justifiable grounds. We shall comply with your objection unless there are justifiable grounds not to do so, for example, for fraud prevention purposes, fraudulent payments, etc.

Your right to object

You have the right to object to the processing of your personal data, including profiling. The processing will be stopped, unless it is necessary to comply with social and fiscal legislation, to protect the interests of a third party, or with a view to instituting legal proceedings, or supporting or exercising a legal claim.

Your right to data portability

You may contact us to request that we transfer the personal data which you have supplied to us to a third party.

Your right to file a complaint

If you disagree with our point of view, you may contact the Belgian Data Protection authority and file a complaint. For the contact details of this authority, please refer to heading 1.4.

Identification of the applicant

You can send us a written application to exercise your rights with regard to the processing of your personal data. For our contact details, please refer to heading 1.3.

Always try to be as specific as possible when exercising your rights. This will enable us to implement your application correctly.

In order to avoid any person exercising your rights fraudulently, we must thoroughly check your identity. Your application must therefore always be accompanied by proof of identity. You can enclose a copy of your identity card with your application. Do ensure that you blacken out your passport photograph and identity card number (etc.) for data protection purposes.

If we judge the document submitted to be sufficient proof, we shall inform you. We reserve the right not to respond to the application until sufficient proof has been provided.

3. Why do we wish to process your personal data?

Avasco Solar NV must comply with its legal obligations.

We are sometimes legally required to process your personal data, and the main reasons are listed below:

  • Tax legislation
  • Commercial legislation
  • Warranty and guarantee legislation
  • There is always the possibility that we may be required to provide personal data to the authorities or other third parties. In the case of a legal requirement, for example, or to perform a public duty.

Avasco Solar must be able to meet its contractual obligations towards you.

As a customer, you may call upon our services or purchase our products. In order to ensure the correct performance of our agreement, we are required to process and manage the administrative, accountancy and operational aspects of these contracts.

The same applies if you are a supplier of Avasco Solar. In that case too, we are required to comply with our contractual obligations and to process and manage the administrative, accountancy and operational aspects of these contracts.

When you visit our website, we enter into an agreement to always offer you an efficiently running website. We therefore install so-called functional cookies.

Avasco Solar has a justifiable commercial interest in processing your personal data.

As a business, we have a number of justifiable interests which form the basis for the processing of personal data. We therefore ensure that there is a correct balance between your right to privacy and the justifiable interests of Avasco Solar. If you still object to the processing on these grounds, you may file an objection against these processes.

We also wish to store your personal data, possibly as a potential customer or a new supplier. The aim is to continue to develop our organisation. We can achieve this by continuing to follow up our replies to your questions or to store the personal data received to contact you at a later date.

However, if you do not wish your personal data to be processed for these purposes, then simply let us know and we can make all the necessary changes.

When you subscribe to our newsletter, you give us your implicit permission to receive information about our products and services. Every newsletter contains an opportunity for you to unsubscribe.

4. What type of personal data do we process and for what purpose?  

Of business contacts

Business contacts are, for example, our customers and suppliers. Avasco Solar processes the personal data of contacts who are employed by companies with whom we do business. We process their data in order to provide them with information about our products and services and to maintain our business relationship.

In order to contact and identify you; to manage our customers and suppliers we process the following data: name, first name, telephone number and/or mobile number, e-mail address, IP address, cookies and employer.

Of our potential customers and potential new suppliers

Our potential customers have an interest in our products and services. Avasco Solar therefore aims to keep them informed. In order to communicate with them and to identify them, we process the following personal data of these contacts: name, first name, telephone number and/or mobile number, e-mail address, IP address, cookies and employer.

Our potential suppliers offer products and services which we may use to run our organisations even more efficiently. In order to be able to contact them again in the future and to identify them, we process the name, first name, telephone number and/or mobile number, e-mail address, IP address, cookies and employer.

Cookies

Avasco Solar makes use of cookies on its websites. These are small data files which are stored on the device used to visit the website, such as a computer, tablet, or smartphone. Whenever we mention ‘cookies’ below, we also mean other comparable techniques. Cookies enable our systems to identify your web browser. That is useful, because it means, for example, that you do not always have to re-enter your data, or give your preferences, or amend your settings. It also makes our website run more efficiently, we can gain an insight into the visitor behaviour on the website and other parties can gain an insight into your surfing behaviour.

Cookies do not jeopardise the security of your computer.

We use functional, analytical, marketing and social media cookies. We ask your consent before we install these small information files, except for the functional cookies which are required for the proper functioning of our website. Surveillance camera images are stored temporarily

We may use cameras in and around our buildings. When we use surveillance cameras, we ensure that we comply with the relevant legislation. Buildings that are under camera surveillance can be identified by a clearly visible sticker.

Video recordings are stored for a maximum of 30 days. This storage period may be extended if the recorded images

  • are useful as proof in the event of a crime or nuisance
  • prove a claim for loss or damage
  • can identify an offender, a witness or a victim

5. About sharing and storing your personal data

With whom do we share your personal data?

We only share your data with persons who have our express permission, and if they need these data to perform their duties. These persons will process your data for the same purposes for which we have received them from you.

For processing personal data we call upon the services of various processing organisations. These are sub-contractors whom we commission to perform this personal data processing. Avasco Solar only works with processing organisations who guarantee the same level of security both technologically and operationally.

Furthermore, we only share your data if we are required to do so by law or if we are ordered to by an authority.

We do not sell or hire out your personal data to any third parties for their personal use.

We do not store your data indefinitely

Avasco Solar uses your personal data with a clear objective in mind. As soon as this objective has been achieved, the data will be removed.

We store the personal data of our potential customers and new suppliers for a period of 10 years. In view of the nature of our products, investments, and liability, we store the personal data of our customers up to 20 years from their last purchase. For our suppliers, the storage period is 10 years.
